Official Terms of Participation in the FFTOC's
Monthly Challenge™

1. Game of Skill:  The FFTOC's Monthly Challenge is a game of skill in which participants use their knowledge and analysis of professional football, and the skills and strategies surrounding the rules governing the FFTOC's Monthly Challenge, to compete against other participants.  Winners are determined by the objective criteria enumerated under the Official Rules of the FFTOC's Monthly Challenge document.

2. Participants:  To enter, individuals must electronically check-off indicating agreement to abide by the official terms, disclaimers and rules governing the FFTOC's Monthly Challenge.  Participants must also submit proper payment via a credit card. Credit card orders are processed via the FFTOC's Monthly Challenge Secure Order Form. No application will be accepted without proper payment, or without applicant authorizing the application.

3. Co-Participants:  Only one person will be considered the manager of a team in the FFTOC's Monthly Challenge and any prize awards will be paid solely to that one individual. Teams may elect to have co-managers if they wish, but for all official FFTOC's Monthly Challenge purposes each team will be owned by one individual.  Co-participants have no legal standing with the FFTOC's Monthly Challenge and may be residents of any state.

4. Refunds/Deposits:  Once a participant authorizes his Official Participant Application for the FFTOC's Monthly Challenge and submits valid payment, no money will be refunded to participants unless the FFTOC's Monthly Challenge is canceled.

5. Eligibility:  The FFTOC's Monthly Challenge is open to legal residents of the 50 United States, Washington D.C., and Canada (excluding Puerto Rico and Quebec) 21 years of age or older other than residents of Arizona, Iowa, Louisiana, Montana and Vermont, (collectively “Restricted States”) who are not eligible to participate. Full Time employees of 4for4.com, Pieracle Inc., Fantasy Tournaments LLC and members of their immediate families are not eligible to play. Immediate family is defined as parent, sibling, or any other person residing in the same household as employee. In addition, all FFTOC.com contributors and any other individuals providing services to fftoc.com are not eligible to win prizes. Contestants must have and supply their own access to a computer and the Internet to manage their teams.

6. Term of FFTOC's Monthly Challenge :  The Contest's first game event begins on DEC 10, 2009 and ends after JAN 3, 2010; spanning four (4) weeks - a month - of NFL action. Signups to join close DEC 13, 2009 9AM EST.

7. Cancellation of Tournament:  In the very unlikely event the FFTOC's Monthly Challenge is cancelled because of an act of terrorism, or any unforeseen catastrophe, or an Act of God, or lack of participation, Fantasy Tournaments LLC will return all entrance fees collected from participants in the cancelled tournament. Fantasy Tournaments LLC and it's members are not responsible for any loss or liability incurred by any participant due to cancellation of the FFTOC's Monthly Challenge .

8. NFL Scheduling:  If for any reason, the National Football League amends any portion of its schedule, Fantasy Tournaments LLC reserves the right to determine prize winners based on an amended FFTOC's Monthly Challenge system. Fantasy Tournaments LLC reserves the right to make any and all reasonable scheduling changes if the NFL alters its schedule.  In the event that the NFL cancels any part of its schedule, Fantasy Tournaments LLC reserves the right to determine FFTOC's Monthly Challenge prizes based on the NFL games already played.

9. Tournament Management/Commissioner: The FFTOC's Monthly Challenge tournament management software was desinged to keep track of tournament reporting, starting lineup submissions, fantasy point calculations, standings and rankings.  All NFL player statistics will be provided by a third party and will serve as the standard for all scoring.  Starting a player that does not play that week will result in a zero score. Fantasy Tournaments LLC will serve as the Commissioner of the FFTOC's Monthly Challenge as it relates to decisions and rulings regarding the tournament.

10. Scoring Discrepancies:  Any and all scoring discrepancies affecting a team must be noted and submitted via email to the FFTOC's Monthly Challenge Commissioners at support@fftoc.com by midnight ET on the Tuesday following the completion of that week’s games.  After 1:00 PM ET on Wednesday of any given week, all scores will be considered final.  It will be up to the sole discretion of Fantasy Tournaments LLC as to the official final statistics of a player as applied to FFTOC's Monthly Challenge.

11. Disputes/Appeals Regarding Rules:  Any disputes or appeals regarding the FFTOC's Monthly Challenge Official Rules will be decided by Fantasy Tournaments LLC using its interpretation of the rules.  Fantasy Tournaments LLC will consider the intent and spirit of the rules; the integrity of the FFTOC's Monthly Challenge ; as well as the feasibility of accommodating any appeal. Any and all disputes or appeals must be submitted via email to support@fftoc.com.  The deadline for submitting a rules dispute or appeal is by midnight ET on the Tuesday following the completion of that game or games in which the dispute has occurred.  Please include a detailed and lucid account of the dispute and resolution requested.  All rulings made by Fantasy Tournaments LLC are final and binding. 

11b. Unattainable Fifty Point Hurdle. While the odds of the scenarios covered in this section may surpass five million to one, we have proactively included them here for you for completeness.

In the highly unlikely and improbable event that all remaining eligible teams score less than fifty points in a single week, then for that week and that week only, the fifty point prize elimination rule will not apply.

Further, if more prizes than eligible teams exist at the end of the contest, the remaining unclaimed prizes will be divided equally amongst the eligible teams.

Example: Only One Team Eligible. If the contest ends with one team eligible to win prizes, then that one team would win all the prizes.

Example: Only Two Teams Eligible. If the contest ends with two teams eligible to win prizes, each of those two teams would claim their winning prize. In addition, those two teams would equally split all the unclaimed prizes.

12. Prize Notification: Winners will be notified by email or regular mail within 30 days after the overall results are posted on the FFTOC web site at the conclusion of FFTOC's Monthly Challenge .  Winners agree to have their name and prize awards announced on the FFTOC web site. The Grand Prize winners agree to submit their photo and have it posted on the FFTOC web site. Any prize notification returned as undeliverable may result in disqualification and selection of an alternate winner.  By accepting any prize, the winner grants permission to Fantasy Tournaments LLC to use their names and/or likenesses for publicity and promotional purposes without further compensation, unless prohibited by law.

13. Prize Money:  All prize money will be secured by Bank of America, one of the nation's leading financial institutions, with all prizes to be paid at the direction of Fantasy Tournaments LLC to the winners as determined by the terms enumerated herein.  All prize money will be mailed out within 30 days after the overall results are posted on the FFTOC web site at the conclusion of the FFTOC's Monthly Challenge . Winners of over $600 dollars will be required to return a W9 form before their prize money can be mailed out. Any interest accrued to prize money does not convey to the prize winner. Any non-cash prizes may be substituted by cash, or by a prize of equal or greater value at the sole discretion of Fantasy Tournaments LLC.

14. Prizes:  All FFTOC's Monthly Challenge prizes are guaranteed.

15. Taxes:  Winners receiving $600.00+ agree to submit their valid and legal social security number to Fantasy Tournaments LLC and winners understand that their social security numbers will be used to report income to the Internal Revenue Service.  All taxes associated with the receipt of any prize are the sole responsibility of the winner.  A form 1099-Misc will be issued to all prize winners receiving $600.00+.

16. Disbursement of Prize Money:  Fantasy Tournaments LLC will distribute 100% of all prize winnings of the FFTOC's Monthly Challenge directly to each winning participant, and only to the winning participant.  Fantasy Tournaments LLC is not responsible for, or bound by, any agreement between the participant and any third parties regarding apportionment of the prize money. It is the resonsibility of each winning manager to verify their mailing address on file is accurate.

17. Participants’ Proprietary Information:  Any proprietary information given to the FFTOC participants, including but not limited to an internet password to access the FFTOC's Monthly Challenge tournament website, shall be kept confidential by both Fantasy Tournaments LLC and the participant. Fantasy Tournaments LLC will not be responsible for any changes made to account information, or the roster or starting line up by third parties or co-team managers who access the FFTOC website.

18. Internet/Technology Problems:  Fantasy Tournaments LLC is not responsible if the Internet portion of the FFTOC's Monthly Challenge is not capable of running as planned, for any reason, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Fantasy Tournaments LLC which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this tournament. Fantasy Tournaments LLC assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation, faulty transmission or communication, line failure, theft, destruction, or unauthorized access to tournament activities conducted or information transmitted via the Internet or the telephone. Fantasy Tournaments LLC is not responsible for a customer's PC configuration and PC setting that may interfer with the FFTOC's Monthly Challenge software. Further, Fantasy Tournaments LLC is not responsible for any problem or technical malfunction of any telephone network, telephone line, cable network, PC, cable, computer on-line system, server, equipment, or software. Fantasy Tournaments LLC is not responsible for the failure of any e-mail or entry or change to be applied to a customer's account due to technical problems or traffic congestion on the Internet or at any web site, phone or fax lines, or any combination thereof, including any injury or damage to a customer's computer related to or resulting from participation in the FFTOC's Monthly Challenge (including without limitation, damages by virus).

19. Team Management Disclaimer:  Fantasy Tournaments LLC is not responsible for any problem or technical malfunction which impedes or interferes with the transmission or receipt of any team transaction, including but not limited to starting lineup submissions.  Fantasy Tournaments LLC is not responsible for the failure of any telephone network or lines, computer online systems, servers, equipment or software, or traffic congestion on the Internet or at any web site, phone lines, or any combination thereof, including any injury or damage to a participant's computer related to or resulting from participation in the FFTOC's Monthly Challenge .

20. Collusion:  Fantasy Tournaments LLC believes unlike old-fashion drafting and other on-line fantasy football games, the unique and exciting elements of the FFTOC's Monthly Challenge play make collusion a non-issue. That said, any participants who collude or attempt to collude in an effort to alter the standings, rankings, or fantasy point totals will be prohibited from winning any prize money and will further have their teams taken over by a surrogate or agent of Fantasy Tournaments LLC  Any participant who attempts to bribe, coerce, blackmail or otherwise influence an officer, agent, affiliate, vendor or surrogate of Fantasy Tournaments LLC in an effort to alter the standings, rankings, or fantasy point totals will be prohibited from winning any prize money and will further have his or her team taken over by a surrogate or agent of Fantasy Tournaments LLC. Any criminal behavior by a participant which attempts to corrupt or alter the fairness of the FFTOC's Monthly Challenge will result in civil and/or criminal prosecution.

21. Team Competitiveness:  Participants are expected to manage their team to the best of their ability for the duration of the FFTOC's Monthly Challenge season.  However, the FFTOC recognizes that some teams could abandon their effort to compete during the season.  This might include the failure to alter or turn in lineups, starting players on a bye, etc.  Fantasy Tournaments LLC regards such behavior as an unavoidable element of any fantasy football league.  As such, Fantasy Tournaments LLC will not directly interfere or alter the management decisions (or indecisions) of any FFTOC's Monthly Challenge participant.

22. Event Tampering:  ANY ATTEMPT BY A PARTICIPANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE THE FFTOC WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE FFTOC IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND IN THE EVENT THAT AN ATTEMPT BE MADE, FANTASY TOURNAMENTS LLC RESERVES THE RIGHT TO SEEK DAMAGES TO THE FULLEST EXTENT OF THE LAW.

23. Disclaimers:  Fantasy Tournaments LLC is not responsible for any FFTOC's Monthly Challenge disruptions, injuries, losses or damages caused by events beyond the control of Fantasy Tournaments LLC or any printing or typographical errors in any materials associated with the FFTOC's Monthly Challenge . Fantasy Tournaments LLC or any subsidiary, affiliated company, or vendor are not in any way responsible or liable for any damage, loss or injury (including death) resulting from any participant’s activity in the FFTOC's Monthly Challenge and related events, and/or acceptance and use of any prize won. Fantasy Tournaments LLC is solely responsible for enacting, administering, enforcing the rules, and maintaining the integrity of the FFTOC.  The FFTOC's Monthly Challenge and web site are not sponsored, affiliated or endorsed by the National Football League or the NFL Players’ Association. Further, this site is not endorsed by any current NFL player or team.

24. Exclusion:  The parties hereby agree that in the event that there is an alleged breach of contract or alleged liability incurred, no party shall commence any proceedings or otherwise seek to impose any liability whatsoever against Fantasy Tournaments LLC or its owners or affiliates and their respective directors, officers, employees and agents, by reason of alleged breach, default or claim.

25. General Release:  By participating in the FFTOC's Monthly Challenge , you release and agree to hold harmless Fantasy Tournaments LLC, participating sponsors and any of their respective parent companies, subsidiaries, affiliates, directors, officers, employees and agencies (collectively, the “Released Parties”) from any liability whatsoever for any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with the FFTOC's Monthly Challenge or acceptance, possession, or use of any prize (including, without limitation, claims, costs, injuries and losses related to personal injuries, death, damage to or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light, whether intentional or unintentional, whether under a theory of contract, tort (including negligence), warrant or other theory.

26. Governing Laws:  FFTOC's Monthly Challenge is governed by the laws of the state of NC without regard to principles of conflicts of law.

27. Headers:  The section headers contained herein are only provided for convenience purposes only and shall not be used to modify or interpret the terms of these Official Rules.

28. Severability:  In the event that any provision of these Terms and Official Rules are found invalid or unenforceable pursuant to judicial decree or decision, the remainder of the Official Rules and Terms shall remain valid and enforceable according to its terms. The parties intend that the provisions of these Official Rules be enforced to the fullest extent permitted by applicable law. Accordingly, the parties agree that if any provisions are deemed not enforceable, they shall be deemed modified to the extent necessary to make them enforceable.
